1. Opposition No B 2 673 195 is upheld for all the contested goods and services, namely:

2. European Union trade mark application No 14 963 128 is rejected in respect of the contested goods and services. It may proceed for the remaining services.
3. The applicant bears the costs, fixed at EUR 650.
REASONS:
The opponent filed an opposition against some of the goods and services of European Union trade mark application No 14 963 128, namely against all the goods in Class 21 and all the services in Classes 35 and 39. The opposition is based on European Union trade mark registration No 12 538 997. The opponent invoked Article 8(1)(b) EUTMR.
PRELIMINARY REMARK
In accordance with Article 41 EUTMR, the notice of opposition must be submitted within the period of three months following the EUTM’s publication.
By indicating the goods and services against which the opposition is directed in accordance with Rule 15(3)(a) EUTMIR the opponent determines the actual scope of the opposition which subsequently may not be extended (24/08/2016, R 1157/2015-5, PlanVet / PlantaVet et al., § 25-26).
The contested trade mark application was published on 07/01/2016. In the notice of opposition filed on 15/03/2016, it was clearly indicated that the opposition was directed against only some of the goods and services, namely those in Classes 21, 35 and 39.
In its submission of 24/08/2016, the opponent indicated that its opposition was directed against all the goods and services of the contested EUTM application, namely all of the goods and services in Classes 21, 35, 39 and 43. However, since this submission was received after the expiry of the three-month period granted for the opponent to determine the scope of the opposition, the indication of the list of contested services in Class 43 filed on 24/08/2016 must be considered an inadmissible extension of the scope of the opposition and cannot, therefore, be taken into account.
Consequently, the Office deems the opposition to have been filed against some of the goods and services, namely against those in Classes 21, 35 and 39.
LIKELIHOOD OF CONFUSION – ARTICLE 8(1)(b) EUTMR
A likelihood of confusion exists if there is a risk that the public might believe that the goods or services in question, under the assumption that they bear the marks in question, come from the same undertaking or, as the case may be, from economically linked undertakings. Whether a likelihood of confusion exists depends on the appreciation in a global assessment of several factors, which are interdependent. These factors include the similarity of the signs, the similarity of the goods and services, the distinctiveness of the earlier mark, the distinctive and dominant elements of the conflicting signs and the relevant public.

The relevant factors relating to the comparison of the goods or services include, inter alia, the nature and purpose of the goods or services, the distribution channels, the sales outlets, the producers, the method of use and whether they are in competition with each other or complementary to each other.
Contested goods in Class 21
The contested combs are identically contained in the opponent’s list of goods.
The contested household containers are the same as the opponent’s household containers, non-electric, since these goods are not commonly differentiated on the basis of their being electric or not. They are identical.
The contested brushes are a broad category to which the opponent’s brushes (except paintbrushes) belong. Since the Opposition Division cannot dissect ex officio the broader category of the contested goods, they are considered identical to the opponent’s goods.
The contested glassware for household purposes; glassware not included in other classes are broad categories to which the opponent’s glasses belong. Since the Opposition Division cannot dissect ex officio the broader categories of the contested goods, they are considered identical to the opponent’s goods.
The contested utensils for household purposes are a broad category to which the opponent’s household utensils, non-electric belong. Since the Opposition Division cannot dissect ex officio the broader category of the contested goods, they are considered identical to the opponent’s goods.
The contested vacuum jars are a type of container used for household purposes; therefore, they are included in the opponent’s broader category of household containers, non-electric. They are identical.
The contested porcelain ware are, de facto, identical to the opponent’s chinaware.
The contested ceramics for household purposes overlap with the opponent’s household or kitchen utensils and containers, non-electric. These goods are, therefore, identical.
Contested services in Class 35
The contested advertising agencies; advertising services provided via the internet; advertisement for others on the Internet belong to the opponent’s broader category of advertising. These services are, therefore, identical.
The contested rental of advertising space on the internet belongs to the opponent’s broader category of rental of advertising space on all means of communication. These services are, therefore, identical.
The contested arranging of commercial and business contacts; arranging commercial transactions, for others, via online shops are services related to the management of an undertaking’s business activities. For this reason, they belong to the broader category of the opponent’s consultancy and assistance in the management of commercial or industrial companies or public institutions. These services are, therefore, identical.
The contested commercial information agencies overlap with the opponent’s providing commercial information, including via directories, on the internet, including on mobile internet. They are identical.
The contested import agency services; import-export agencies are similar to the opponent’s consultancy and assistance in the management of commercial or industrial companies or public institutions, as they can have the same producers, end users and distribution channels.
The contested department store retail services connected with the sale of beauty products, toiletries overlap with the opponent’s retail services related to the aforementioned goods namely perfumery, soaps, cosmetics. They are considered identical.
The contested department store retail services connected with the sale of machines for household use, domestic electrical equipment overlap with the opponent’s retail services related to the aforementioned goods namely apparatus and installations for lighting, heating, steam generating, cooking, refrigerating, drying, ventilating, water supply. They are considered identical.
The contested department store retail services connected with the sale of domestic electronic equipment overlap with the opponent’s retailing of all the aforesaid goods namely data processing apparatus. They are considered identical.
The contested department store retail services connected with the sale of optical goods are included in the broader category of the opponent’s retailing of optical apparatus and instruments. Therefore, they are identical.
The contested department store retail services connected with the sale of hand tools are included in the broader category of the opponent’s retailing of all the aforesaid goods, namely hand tools and implements (hand-operated). Therefore, they are identical.
The contested wholesale services in relation to fabrics; wholesale services in relation to furniture; wholesale services in relation to tableware; wholesale services in relation to furnishings; wholesale services in relation to foodstuffs; wholesale services in relation to sanitary installations are considered similar to the opponent’s wholesaling of fences and bar fencing, grilles, gates, small doors, posts and fence panels, grids and barred gratings, bars for railings, barriers. These services have the same nature, since both are wholesale services, and the same purpose of selling products in significant quantities, usually for resale.
Contested services in Class 39
Storage of goods is identically contained in both lists of services.
The contested storage (listed twice) includes, as a broader category, the opponent’s storage of goods. Since the Opposition Division cannot dissect ex officio the broad category of the contested services, they are considered identical to the opponent’s services.
The contested food storage services; storage of liquids belong to the opponent’s broader category of storage of goods. These services are, therefore, identical.
The contested transportation; delivery of goods; distribution services; parcel receipt services refer to the same services as, are included in the broader category of or overlap with the opponent’s transport services. They are identical.
The contested wrapping and packaging services are included in the broader category of the opponent’s packaging, packing and wrapping of products, goods and packages. They are identical.
The contested providing information relating to warehousing services is similar to the opponent’s [rental of garages and parking areas and] providing information relating thereto, since it is very common for garages and parking lots to be rented out and used for warehousing purposes. These services are usually provided by the same undertakings to the same customers.
- Relevant public — degree of attention
The average consumer of the category of products concerned is deemed to be reasonably well informed and reasonably observant and circumspect. It should also be borne in mind that the average consumer’s degree of attention is likely to vary according to the category of goods or services in question.
In the present case, the goods and services found to be identical or similar are directed at both professionals and the general public. The degree of attention varies from average to higher than average, depending on the price, specialised nature, or terms and conditions of the purchased goods or services.

The relevant territory is the European Union.
The global appreciation of the visual, aural or conceptual similarity of the marks in question must be based on the overall impression given by the marks, bearing in mind, in particular, their distinctive and dominant components (11/11/1997, C-251/95, Sabèl, EU:C:1997:528, § 23).
The earlier mark consists of the word ‘Lippi’ in blue upper case letters. The contested mark comprises the word ‘Glippi’. Neither word has a meaning in relation to the relevant goods and services; therefore, they both have an average degree of distinctiveness.
Visually, the contested sign incorporates the earlier mark in its entirety, and it includes an additional letter ‘G’ at its beginning. The signs differ in the blue colour of the earlier mark. As the signs coincide visually in five letters, constituting the whole of the earlier mark, and this is offset to only a limited extent by the additional letter ‘G’ in the contested sign and the colour of the earlier mark, the signs must be considered visually highly similar.
Aurally, irrespective of the different pronunciation rules in different parts of the relevant territory, the pronunciation of the signs coincides in the sound of the letters ‘*LIPPI’ and differs in only the additional letter ‘G’ at the beginning of the contested sign. This differing letter is unable to counteract the impact of the coincidence in the rest of the phonemes, including the rather unusual double ‘P’ in the middle of the signs. Therefore, the signs, overall, are aurally highly similar.
Conceptually, neither of the signs has a meaning for the public in the relevant territory. Since a conceptual comparison is not possible, the conceptual aspect does not influence the assessment of the similarity of the signs.
As the signs have been found similar in at least one aspect of the comparison, the examination of likelihood of confusion will proceed.
- Distinctiveness of the earlier mark
The distinctiveness of the earlier mark is one of the factors to be taken into account in the global assessment of likelihood of confusion.
The opponent did not explicitly claim that its mark is particularly distinctive by virtue of intensive use or reputation.
Consequently, the assessment of the distinctiveness of the earlier mark will rest on its distinctiveness per se. In the present case, the earlier trade mark has no meaning for any of the goods and services in question from the perspective of the public in the relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as normal.
- Global assessment, other arguments and conclusion
Account is taken of the fact that average consumers rarely have the chance to make a direct comparison between different marks, but must trust in their imperfect recollection of them (22/06/1999, C-342/97, Lloyd Schuhfabrik, EU:C:1999:323, § 26).
It should be noted that even consumers who pay a high degree of attention need to rely on their imperfect recollection of trade marks (21/11/2013, T-443/12, ancotel, EU:T:2013:605, § 54).
The goods and services are identical or similar and the signs are visually and aurally highly similar, while they lack any meaning that could differentiate them. The differences between the signs are confined to secondary elements, such as the earlier mark’s typeface and colour, and to the additional letter ‘G’ in the contested sign, which cannot counteract the similarities between them.
Considering all the above, there is a likelihood of confusion on the part of the public, even for consumers who pay a higher than average degree of attention.
Therefore, the opposition is well founded on the basis of the opponent’s European Union trade mark registration. It follows that the contested trade mark must be rejected for all the contested goods and services.
COSTS
According to Article 85(1) EUTMR, the losing party in opposition proceedings must bear the fees and costs incurred by the other party.
Since the applicant is the losing party, she must bear the opposition fee as well as the costs incurred by the opponent in the course of these proceedings.
According to Rule 94(3) and (6) and Rule 94(7)(d)(i) EUTMIR, the costs to be paid to the opponent are the opposition fee and the costs of representation which are to be fixed on the basis of the maximum rate set therein.

According to Article 59 EUTMR, any party adversely affected by this decision has a right to appeal against this decision. According to Article 60 EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. It must be filed in the language of the proceedings in which the decision subject to appeal was taken. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 720 has been paid.
The amount determined in the fixation of the costs may only be reviewed by a decision of the Opposition Division on request. According to Rule 94(4) EUTMIR, such a request must be filed within one month from the date of notification of this fixation of costs and shall be deemed to be filed only when the review fee of EUR 100 (Annex I A(33) EUTMR) has been paid.
