LIKELIHOOD OF CONFUSION – ARTICLE 8(1)(b) EUTMR

A likelihood of confusion exists if there is a risk that the public might believe that the goods or services in question, under the assumption that they bear the marks in question, come from the same undertaking or, as the case may be, from economically linked undertakings. Whether a likelihood of confusion exists depends on the appreciation in a global assessment of several factors, which are interdependent. These factors include the similarity of the signs, the similarity of the goods and services, the distinctiveness of the earlier mark, the distinctive and dominant elements of the conflicting signs and the relevant public.

An interpretation of the wording of the list of goods and services is required to determine the scope of protection of these goods and services.

The terms ‘in particular’ and ‘including’, used in both lists of goods and services, indicates that the specific goods and services are only examples of items included in the category and that protection is not restricted to them. In other words, it introduces a non-exhaustive list of examples (see the judgment of 09/04/2003, T-224/01, Nu-Tride, EU:T:2003:107).

However, the term ‘namely’, used in the opponent’s list of goods and services to show the relationship of individual goods and services with a broader category, is exclusive and restricts the scope of protection only to the specifically listed goods and services.

The relevant factors relating to the comparison of the goods or services include, inter alia, the nature and purpose of the goods or services, the distribution channels, the sales outlets, the producers, the method of use and whether they are in competition with each other or complementary to each other.

The signs are identical.

  1. Global assessment, other arguments and conclusion

Since the marks are identical, the similarity of the goods and services is sufficient to affirm a likelihood of confusion (16/12/2009, T-483/08, Giordano Enterprises Ltd., EU: T: 2009: 515, § 32).

Therefore, the opposition is well founded on the basis of the opponent’s French trade mark registration No 3 692 086. It follows that the contested trade mark must be rejected for all the contested goods and services.

The signs were found to be identical and a part of the contested goods and services, namely audiovisual productions; scientific, surveying, weighing, measuring, checking (supervision); The aforesaid goods not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid goods not relating to loyalty schemes in the field of retail; promoting the goods and services of others by placing advertisements and promotional articles on an electronic site accessed through computer networks; Mediation in the establishment of business contacts via the Internet (public relations); Presentation of companies on the internet and other media; Market prospecting and analysis; Organisation of trade fairs and exhibitions for commercial or advertising purposes; Advertising; Dissemination of advertisements; Information and consultancy relating to the aforesaid services; All the aforesaid services whether or not provided via electronic channels, including the Internet; The aforesaid services not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid services not relating to loyalty schemes in the field of retail; Publication, lending and dissemination of newsletters, books, newspapers, magazines, guidebooks, TV guides, brochures, posters, business cards and other printed matter; Recording studios; Services of editorial offices (non-advertising), in particular the editing of non-advertising texts; Presentation of goods and services using audio-visual productions, for educational purposes; organisation of competitions; Organisation of exhibitions and trade fairs for sports purposes; Organisation of exhibitions and trade fairs for cultural or educational purposes; Audiovisual (multimedia) production; Organising radio and television broadcasts/programmes; Education; Providing of training; Entertainment; Sporting and cultural activities; Arranging and conducting of courses, lectures, training sessions, workshops, symposiums, congresses, seminars and other educational activities; All the aforesaid services whether or not provided via electronic channels, including the Internet; The aforesaid services not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid services not relating to loyalty schemes in the field of retail; research services; Information and consultancy relating to the aforesaid services; The aforesaid services also via electronic channels, including the Internet; The aforesaid services not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid services not relating to loyalty schemes in the field of retail are identical. Therefore, the opposition must be upheld under Article 8(1)(a) EUTMR for these goods and services.

Furthermore, the remaining contested goods and services digital data files (downloadable); Audio recordings featuring music; Digital music; Electronic publications, downloadable; The aforesaid goods not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid goods not relating to loyalty schemes in the field of retail; Mediation for publicity; negotiating and concluding commercial transactions for others; Opinion polling; Information and consultancy relating to the aforesaid services; All the aforesaid services whether or not provided via electronic channels, including the Internet; The aforesaid services not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid services not relating to loyalty schemes in the field of retail; Publication, lending and dissemination of software; Information and consultancy relating to the aforesaid services; All the aforesaid services whether or not provided via electronic channels, including the Internet; The aforesaid services not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid services not relating to loyalty schemes in the field of retail; Industrial analysis Information and consultancy relating to the aforesaid services; The aforesaid services also via electronic channels, including the Internet; The aforesaid services not relating to goods from an online store, mail order company, pay television broadcaster or telecoms provider; The aforesaid services not relating to loyalty schemes in the field of retail were found to be similar to those covered by the earlier trade mark. Given the identity of the signs, there is a likelihood of confusion within the meaning of Article 8(1)(b) EUTMR and the opposition must also be upheld for these goods and services.
