On 16/11/2017, the Opposition Division takes the following
DECISION:
1. Opposition No B 2 507 658 is upheld for all the contested goods, namely:
Class 7: Machines for use in the automotive industry, and automotive
workshops, garages for automotive repair and automotive technical testing
centres, and machine tools.
Class 8: Hand held tools, hand implements (hand-operated) for the
construction of machines, apparatus and vehicles and for technical testing of
vehicles.
2. European Union trade mark application No 13 333 703 is rejected for all the
contested goods. It may proceed for the remaining goods:
Class 7: Motors, other than for land vehicles, couplings and transmission belts,
other than for land vehicles.
Class 9: Weighing, measuring, signalling and checking (supervision) apparatus
(all the aforesaid being for use in the technical testing of vehicles).
3. The applicant bears the costs, fixed at EUR 650.
As from 01/10/2017, Regulation (EC) No 207/2009 and Regulation (EC) No 2868/95
have been repealed and replaced by Regulation (EU) 2017/1001 (codification),
Delegated Regulation (EU) 2017/1430 and Implementing Regulation (EU)
2017/1431, subject to certain transitional provisions. All the references in this
decision to the EUTMR, EUTMDR and EUTMIR shall be understood as references to
the Regulations currently in force, except where expressly indicated otherwise.

REASONS
The opponent filed an opposition against some of the goods of European Union trade
mark application No 13 333 703 , namely against some of the goods in
Class 7 and all the goods in Class 8. The opposition is based on, inter alia, Spanish
trade mark registration No 1 554 491 . The opponent invoked Article 8(1)
(b) EUTMR.
On 29/11/2016 the Opposition Division rendered a decision that resulted in the
rejection of the opposition pursuant to Article 47(2) and (3) EUTMR on the grounds
that the evidence submitted by the opponent was insufficient to prove that the earlier
trade marks were genuinely used.
The decision was appealed and the Board of Appeal decided in case R 219/2017-1
on 15/09/2017. The Board’s decision annulled the contested decision and remitted
the case to the Opposition Division for further prosecution. The Board considered that
the examination of the proof of use carried out by the Opposition Division did not take
into account the full set of evidence.
PROOF OF USE
In accordance with Article 42(2) and (3) EUTMR (in the version in force at the time of
filing of the opposition, now Article 47(2) and (3) EUTMR), if the applicant so
requests, the opponent must furnish proof that, during the five-year period preceding
the date of publication of the contested trade mark, the earlier trade mark has been
put to genuine use in the territories in which it is protected in connection with the
goods or services for which it is registered and which the opponent cites as
justification for its opposition, or that there are proper reasons for non-use. The
earlier mark is subject to the use obligation if, at that date, it has been registered for
at least five years.
The same provision states that, in the absence of such proof, the opposition will be
rejected.
The applicant requested that the opponent submit proof of use of the trade marks on
which the opposition is based, Spanish trade marks No 1 554 491 and No 2 221 311
both for the figurative sign .
The contested application was published on 13/01/2015. The opponent was therefore
required to prove that the trade marks on which the opposition is based were put to
genuine use in Spain from 13/01/2010 to 12/01/2015 inclusive.
The request was submitted in due time and is admissible as the earlier trade marks
were registered more than five years prior to the relevant date mentioned above.
Furthermore, the evidence must show use of the trade marks for the goods and
services on which the opposition is based, namely the following:

According to Rule 22(3) EUTMIR (in the version in force at the moment of filing the
request for proof of use), the evidence of use must consist of indications concerning
the place, time, extent and nature of use of the opposing trade mark for the goods or
services in respect of which it is registered and on which the opposition is based.
On 30/10/2015, in accordance with Rule 22(2) EUTMIR (in the version in force at the
moment of filing the request for proof of use), the Office gave the opponent until
30/12/2015 to submit evidence of use of the earlier trade marks. On 23/12/2015,
within the time limit, the opponent submitted evidence of use.
The evidence to be taken into account is the following:
A significant number of invoices issued by the opponent to its clients: 47 from
2011, 41 from 2012, 49 from 2013, 42 from 2014 and 41 from 2015; among the
invoices dating from 2015, only one is dated within the relevant period. Therefore,
the number of invoices to be taken into account is 180, issued during the four
years from 11/01/2011 to 11/01/2015.
A significant number of invoices dated between 2011 and 2015, sent to the
opponent for the purchase of various goods or the provision of services for the
running of its business. The goods include brass wire, plates, bars, saws, copper
rounds, drills, straps, grinders, tubes, stationery and graphics.

Invoice forms.

All the documents and, more specifically, the invoices show that the place of use is
Spain. This can be inferred from the currency mentioned (euros) and from the
addresses, all in the province of Guipúzcoa, in the north of Spain. Therefore, the
evidence relates to the relevant territory.
Most of the evidence is dated within the relevant period.
The number of invoices and the continuous period during which they were issued
provide the Opposition Division with sufficient information concerning the commercial
volume, the territorial scope, the duration, and the frequency of use.

As the opponent explains, its business is a ‘small workshop for machining parts and
pieces, construction of machinery under sample or drawing, EDM and high-speed
machining that only works on request, according to customer’s specific demands’.
Every invoice has been translated into the language of the proceedings. The work
invoiced includes, for example:
‘make piece according to sample; the production of various parts and pieces of
metal such as: screws, nuts, threads¸ washers, closing cap, rollers for conveyor,
springs, rail, or tooling’;
‘change plate according to scheme; remove broken drill, screw or bolt; change
handrail; cleaning and maintenance of molds; modify parts; enlarge diameter;
reform equipment; or installation and repair leaks’.
The opponent’s submissions and evidence show that the opponent’s business
activities are carried out in a specialised market and appear to include, in particular,
custom maintenance and repair services. The evidence suggests that those services
may also include the production of certain individual parts for machines.
Therefore, the evidence shows that the marks have been used in accordance with
their function and as registered for all the goods and services for which they are
registered.
The Court of Justice has held that there is ‘genuine use’ of a mark where it is used in
accordance with its essential function, which is to guarantee the identity of the origin
of the goods or services for which it is registered, in order to create or preserve an
outlet for those goods or services. Genuine use does not include token use for the
sole purpose of preserving the rights conferred by the mark. Furthermore, the
condition of genuine use of the mark requires that the mark, as protected in the
relevant territory, be used publicly and outwardly (11/03/2003, C40/01, Minimax,
EU:C:2003:145 and 12/03/2003, T-174/01, Silk Cocoon, EU:T:2003:68).
Taking into account the evidence in its entirety, the evidence submitted by the
opponent is sufficient to prove genuine use of the earlier trade marks during the
relevant period in the relevant territory.
LIKELIHOOD OF CONFUSION — ARTICLE 8(1)(b) EUTMR
A likelihood of confusion exists if there is a risk that the public might believe that the
goods or services in question, under the assumption that they bear the marks in
question, come from the same undertaking or, as the case may be, from
economically linked undertakings. Whether a likelihood of confusion exists depends
on the appreciation in a global assessment of several factors, which are
interdependent. These factors include the similarity of the signs, the similarity of the
goods and services, the distinctiveness of the earlier mark, the distinctive and
dominant elements of the conflicting signs, and the relevant public.
The opposition is based on more than one earlier trade mark. The Opposition
Division finds it appropriate to first examine the opposition in relation to the
opponent’s earlier Spanish trade mark No 1 554 491.

a) The goods
The goods on which the opposition is based are the following:
Class 7: Machines and machine-tools.
The contested goods are the following:
Class 7: Machines for use in the automotive industry, and automotive workshops,
garages for automotive repair and automotive technical testing centres, and machine
tools.
Class 8: Hand held tools, Hand implements (hand-operated) for the construction of
machines, apparatus and vehicles and for technical testing of vehicles.
The relevant factors relating to the comparison of the goods or services include, inter
alia, the nature and purpose of the goods or services, the distribution channels, the
sales outlets, the producers, the method of use and whether they are in competition
with each other or complementary to each other.
Contested goods in Class 7
Machine tools are identically contained in both lists of goods.
The opponent’s machines and machine-tools and the contested machines for use in
the automotive industry, and automotive workshops, garages for automotive repair
and automotive technical testing centres have the same nature. Their purpose, in the
broadest sense, may also be the same in that the goods are in both cases machines
for carrying out a particular kind of work. To that extent, these goods are similar to a
low degree. However, in the absence of an express limitation by the opponent to
clarify its goods, it cannot be assumed that they coincide in other criteria.
Contested goods in Class 8
The contested hand held tools, hand implements (hand-operated) for the
construction of machines, apparatus and vehicles and for technical testing of
vehicles are similar to the opponent’s machines and machine-tools, as they have the
same purpose. They can have the same end users and distribution channels.
Furthermore, they are in competition.
b) Relevant public — degree of attention
The average consumer of the category of products concerned is deemed to be
reasonably well informed and reasonably observant and circumspect. It should also
be borne in mind that the average consumers degree of attention is likely to vary
according to the category of goods or services in question.
In the present case, the goods found to be identical or similar to varying degrees are
directed at the public at large and at business customers with specific professional
knowledge or expertise.

The degree of attention will vary from average to high, considering the degree of
specialisation and the cost of the relevant goods, as well as the frequency with which
they are purchased.
c) The signs
Earlier trade mark Contested sign
The relevant territory is Spain.
The global appreciation of the visual, aural or conceptual similarity of the marks in
question must be based on the overall impression given by the marks, bearing in
mind, in particular, their distinctive and dominant components (11/11/1997, C-251/95,
Sabèl, EU:C:1997:528, § 23).
The earlier mark is figurative and consists of the word ‘mekalan’, in standard lower
case white letters, set against a black background. Above this element is a figurative
element formed of a black ribbon resembling a large upper case letter ‘M’.
The contested sign is also figurative and features the words ‘MECAand ‘Lan’, with
‘MECA’ in standard orange upper case letters, and ‘Lan’ in black title case letters set
against an orange circle.
The element ‘mekalan’ of the earlier mark has no meaning for the relevant public and
is, therefore, distinctive.
Part of the public may perceive the word ‛MECA’ in the contested sign as referring to
‛mecánico’, that is, ‘mechanical’ in English (information extracted from
http://dictionary.reverso.net/ on 27/10/2017), which is used to refer to an automobile
repair shop. Bearing in mind that some of the relevant goods relate to automotive
machinery, it is considered that this element is weak for these goods. On the other
hand, the word ‛MECA has a normal degree of distinctiveness for the part of the
public that will not associate it with the meaning explained above. The element ‘Lan’
of the contested sign has no meaning for the relevant public and is, therefore,
distinctive.
Neither of the marks has any element that could be considered more dominant
(visually eye-catching) than other elements.
When signs consist of both verbal and figurative components, in principle, the verbal
component of the sign usually has a stronger impact on the consumer than the
figurative component. This is because the public does not tend to analyse signs and
will more easily refer to the signs in question by their verbal element than by
describing their figurative elements (14/07/2005, T-312/03, Selenium-Ace,
EU:T:2005:289, § 37).

Visually, the signs coincide in the letters ‘ME*ALAN’, which are in the same order,
albeit in different typefaces. However, they differ in their third letters, ‘K’ in the earlier
mark and ‘C’ in the contested sign, and in their figurative elements.
Taking into account the limited impact of the signs’ figurative elements and the
commonality in six out of seven letters, and bearing in mind that ‘Lan’ is the most
distinctive element of the contested sign, the signs are visually similar to an average
degree.
Aurally, the pronunciation of the signs is identical, as in Spanish the letters ‘K’ and
‘C’, when followed by the vowel ‘A’, ‘O’ or ‘U’, are pronounced the same.
Conceptually, although part of the public in the relevant territory will perceive the
meaning of the element ‛MECA of the contested sign as explained above, the other
sign has no meaning in that territory. Since one of the signs will not be associated
with any meaning, the signs are not conceptually similar.
As the signs have been found similar in at least one aspect of the comparison, the
examination of likelihood of confusion will proceed.
d) Distinctiveness of the earlier mark
The distinctiveness of the earlier mark is one of the factors to be taken into account
in the global assessment of likelihood of confusion.
The opponent did not explicitly claim that its mark is particularly distinctive by virtue
of intensive use or reputation.
Consequently, the assessment of the distinctiveness of the earlier mark will rest on its
distinctiveness per se. In the present case, the earlier trade mark as a whole has no
meaning for any of the goods in question from the perspective of the public in the
relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as
normal.
e) Global assessment, other arguments and conclusion
The contested goods are identical or similar to various degrees to the opponent’s
goods, and they target the public at large and professionals, whose degree of
attention is average to high. Furthermore, the earlier mark has a normal degree of
distinctiveness.
The signs under comparison are aurally identical, visually similar to an average
degree and conceptually not similar.
The signs have in common six out of seven letters and are pronounced identically;
the final word, ‘Lan’, is the most distinctive element of the contested sign.
In general terms, two marks are similar when, from the point of view of the relevant
public, they are at least partially identical as regards one or more relevant aspects
(23/10/2002, T-6/01, Matratzen, EU:T:2002:261, § 30; 12/07/2006, T-97/05,
Marcorossi, EU:T:2006:203, § 39; 22/06/2005, T-34/04, Turkish Power,
EU:T:2005:248, § 43).

Furthermore, consumers normally perceive a mark as a whole and do not analyse its
details. This is particularly relevant when, as in the present case, the signs have no
concept that could serve to deflect consumers’ attention from the similar letters in the
marks.
Account is taken of the fact that average consumers rarely have the chance to make
a direct comparison between different marks, but must trust in their imperfect
recollection of them (22/06/1999, C-342/97, Lloyd Schuhfabrik, EU:C:1999:323,
§ 26). Even consumers who pay a high degree of attention need to rely on their
imperfect recollection of trade marks (21/11/2013, T-443/12, ancotel, EU:T:2013:605,
§ 54).
Evaluating likelihood of confusion implies some interdependence between the
relevant factors and, in particular, a similarity between the marks and between the
goods or services. Therefore, a lesser degree of similarity between goods and
services may be offset by a greater degree of similarity between the marks and vice
versa (29/09/1998, C-39/97, Canon, EU:C:1998:442, § 17).
Considering all the above, there is a likelihood of confusion on the part of the public.
Therefore, the opposition is well founded on the basis of the opponent’s Spanish
trade mark No 1 554 491. It follows that the contested trade mark must be rejected
for all the contested goods, even for those found to be similar to a low degree.
As earlier Spanish trade mark No 1 554 491 leads to the success of the opposition
and to the rejection of the contested trade mark for all the goods against which the
opposition was directed, there is no need to examine the other earlier rights invoked
by the opponent (16/09/2004, T-342/02, Moser Grupo Media, S.L., EU:T:2004:268).
COSTS
According to Article 109(1) EUTMR, the losing party in opposition proceedings must
bear the fees and costs incurred by the other party.
Since the applicant is the losing party, it must bear the opposition fee as well as the
costs incurred by the opponent in the course of these proceedings.
According to Article 109(1) and (7) EUTMR and Article 18(1)(c)(i) EUTMIR (former
Rule 94(3) and (6) and Rule 94(7)(d)(i) EUTMIR, in force before 01/10/2017), the
costs to be paid to the opponent are the opposition fee and the costs of
representation, which are to be fixed on the basis of the maximum rate set therein.

According to Article 67 EUTMR, any party adversely affected by this decision has a
right to appeal against this decision. According to Article 68 EUTMR, notice of appeal
must be filed in writing at the Office within two months of the date of notification of
this decision. It must be filed in the language of the proceedings in which the decision
subject to appeal was taken. Furthermore, a written statement of the grounds for
appeal must be filed within four months of the same date. The notice of appeal will be
deemed to have been filed only when the appeal fee of EUR 720 has been paid.
The amount determined in the fixation of the costs may only be reviewed by a
decision of the Opposition Division on request. According to Article 109(8) EUTMR
(former Rule 94(4) EUTMIR, in force before 01/10/2017), such a request must be
filed within one month of the date of notification of this fixation of costs and will be
deemed to have been filed only when the review fee of EUR 100
(Annex I A(33) EUTMR) has been paid.
