3. Il marchio dell’Unione europea rimane registrato per tutti i prodotti non contestati,

Classe 5: Articoli assorbenti per l'igiene personale.
4. La titolare del MUE sopporta l’onere delle spese, fissate in Euro 1 080.
MOTIVAZIONI
In data 30/12/2016 la richiedente ha presentato una domanda di nullità contro il
marchio dell’Unione Europea n. 15 480 718 (nel prosieguo il ‘MUE contestato’),
depositato il 26/05/2016 e registrato il 12/09/2016, per il seguente segno figurativo:
La richiesta è diretta contro una parte dei prodotti coperti dal MUE contestato, ossia:
Classe 3: Cosmetici e preparati cosmetici.
La domanda si basa sulle seguenti registrazioni anteriori:
Registrazione di marchio italiano n. 697 792 ‘INCODERM’ (marchio verbale),
depositato il 24/04/1996, registrato il 23/12/1996 e oggetto di ultimo rinnovo
rubricato al n. 302 015 000 054 837;

Registrazione di marchio internazionale n. 66 69 33 del 15/11/1996, debitamente
rinnovato, che designa Benelux, Francia, Grecia, Polonia, Portogallo, Repubblica
Ceca, Slovacchia Slovenia e Ungheria, per il marchio denominativo ‘INCODERM’.
La richiedente ha invocato l’articolo 60, paragrafo 1, lettera a), RMUE in combinato
disposto con l’articolo 8, paragrafo 1, lettera b), RMUE.
Rilievi preliminari
A decorrere dal 01/10/2017, il regolamento (CE) n. 207/2009 e il regolamento (CE) n.
2868/95 sono stati abrogati e sostituiti dal regolamento (UE) 2017/1001 (versione
codificata) (‘RMUE’), dal regolamento delegato (UE) 2017/1430 (‘RDMUE’) e dal
regolamento di esecuzione (UE) 2017/1431 (‘REMUE’), senza pregiudizio delle
disposizioni transitorie. Ogni richiamo al RMUE, al RDMUE e al REMUE contenuto
nella presente decisione fa riferimento ai regolamenti attualmente in vigore, salvo che
sia altrimenti indicato.
SINTESI DEGLI ARGOMENTI DELLE PARTI
La richiedente sostiene che sussiste un rischio di confusione tra i diritti anteriori
invocati ed il MUE contestato, in virtù della somiglianza tra gli elementi verbali
‘INCODERM’ e ‘ICNODERM’, nonché della identità e/o somiglianza tra i rispettivi
prodotti protetti nella classe 3.
A sostegno delle proprie osservazioni, la richiedente ha fornito copia dei certificati di
registrazione dei marchi anteriori accompagnati dai rispettivi certificati di rinnovo.
La titolare del MUE non ha presentato alcuna osservazione in risposta alla domanda di
dichiarazione di nullità.
RISCHIO DI CONFUSIONE ARTICOLO 60, PARAGRAFO 1, LETTERA a), RMUE
IN COMBINATO DISPOSTO CON LARTICOLO 8, PARAGRAFO 1, LETTERA b),
RMUE
Sussiste un rischio di confusione se vi è il rischio che il pubblico possa ritenere che i
prodotti o i servizi in questione, qualora rechino i marchi di cui trattasi, provengano
dalla medesima impresa o, a seconda dei casi, da imprese economicamente collegate.
La sussistenza di un rischio di confusione dipende dall’apprezzamento nell’ambito di
una valutazione complessiva di diversi fattori che sono in rapporto di reciproca
dipendenza. Tali fattori includono la somiglianza dei segni, la somiglianza dei prodotti e
dei servizi, il carattere distintivo del marchio anteriore, gli elementi distintivi e dominanti
dei segni in conflitto così come il pubblico di riferimento.
La domanda si basa su più di un marchio anteriore. La Divisione di Annullamento
ritiene opportuno, in primo luogo, esaminare la domanda in relazione al marchio
italiano n. 697 792 ‘INCODERM’ (rinnovato al n. 302 015 000 054 837).
a) I prodotti
I prodotti sui quali si basa la domanda sono, tra gli altri, i seguenti:
Classe 3: Creme di bellezza per la cura del viso e del corpo, lozioni per capelli.

I prodotti contestati sono i seguenti:
Classe 3: Cosmetici e preparati cosmetici.
I cosmetici e preparati cosmetici protetti dal marchio impugnato sono sostanze o
preparazioni naturali o di sintesi atte a curare e conservare la salute della pelle, capelli,
unghie, ecc. Tali sostanze o preparazioni sono generalmente utilizzate allo scopo di
migliorare l'aspetto della persona e, come tali, includono, tra gli altri, creme di bellezza
per la cura del viso e del corpo e lozioni per capelli del segno anteriore. Di
conseguenza, tali prodotti sono identici.
b) Pubblico di riferimento – grado di attenzione
Secondo costante giurisprudenza, nell’ambito della valutazione globale del rischio di
confusione, occorre prendere in considerazione il consumatore medio della categoria
di prodotti di cui trattasi, normalmente informato e ragionevolmente attento ed accorto.
Occorre anche tener conto del fatto che il livello di attenzione del consumatore medio
può variare in funzione della categoria di prodotti o di servizi di cui trattasi (13/02/2007,
T 256/04, Respicur, EU:T:2007:46, § 42).
In considerazione della natura dei prodotti ritenuti identici in classe 3, si deve ritenere
che nella fattispecie il pubblico di riferimento sia costituito dal grande pubblico, al quale
non è possibile ascrivere una soglia di attenzione elevata al momento dell’acquisto
(14/04/2011, T 466/08, Acno focus, EU:T:2011:182, § 49).
c) I segni
INCODERM
Marchio anteriore Marchio contestato
Il territorio di riferimento è l’Italia.
La valutazione globale della somiglianza visiva, fonetica o concettuale dei marchi di cui
trattasi deve fondarsi sull’impressione complessiva prodotta tenendo conto dei loro
elementi distintivi e dominanti (11/11/1997, C-251/95, Sabèl, EU:C:1997:528, § 23).
Il marchio anteriore è un segno puramente denominativo che consta dell’unica parola
‘INCODERM’ e, in quanto tale, non contiene elementi che possano considerarsi
dominanti sotto il profilo visivo.
Il MUE contestato è un segno figurativo costituito dalla parola ‘ICNODERM’, trascritta
in caratteri maiuscoli standard. Alla destra della lettera ‘M’, in alto, è posto il simbolo ®,
in dimensioni molto ridotte e che sarà ignorato nella comparazione poiché semplice
indicazione che il marchio è registrato. Sopra le lettere ‘ER’ compare, inoltre, un
simbolo grafico di fantasia di dimensioni minori. Il marchio è chiaramente dominato sul
piano visivo dalla parola ‘ICNODERM’, posta maggiormente in risalto rispetto le
ulteriori componenti del segno appena descritte.

In merito alla capacità distintiva delle componenti che costituiscono i segni a raffronto,
occorre premettere che anche i marchi denominativi composti di una sola parola
possono contenere vari elementi, alcuni dei quali possono essere più distintivi di altri
(27/01/2010, T-331/08 Solfrutta, EU:T:2010:23, § 21). Infatti, sebbene il consumatore
medio percepisca normalmente un marchio come un tutt’uno e non effettui un esame
dei suoi singoli elementi, ciò non toglie che il consumatore stesso, percependo un
elemento verbale, lo scomporrà in parti che suggeriscono un significato concreto o che
somigliano a vocaboli a lui noti (13/02/2007, T-256/04, Respicur, EU:T:2007:46, § 57).
Nel caso di specie, entrambi i segni contengono la sequenza finale ‘-DERM’, la quale
verrà relazionata dal pubblico rilevante all’espressione “derma” utilizzata nella lingua
italiana come “primo o secondo elemento di parole dotte o di termini scientifici (anche
latini) con il sign. fondamentale di «pelle»” (da Vocabolario Treccani). Posto che i
prodotti in esame possono essere utilizzati per la cura della pelle, è ragionevole
ritenere che i consumatori percepiranno la parte finale dei termini ‘INCODERM’ e
‘ICNODERM’ come un’indicazione della destinazione d’uso dei prodotti rilevanti e,
pertanto, che le porzioni iniziali ‘INCO-’, nel marchio anteriore, e ‘ICNO-’, nel MUE
contestato, siano le componenti maggiormente distintive dei segni, poiché prive di
significato nella lingua italiana.
Sotto il profilo visivo, i marchi sono simili nella misura in cui essi coincidono nelle
lettere “I-*-*-O-D-E-R-M”. Il segno anteriore e l’unico elemento verbale del MUE
contestato, che ne costituisce anche la componente dominante, si differenziano
solamente per l’inversione delle lettere ‘N’ e ‘C’. Tenuto conto che l’ulteriore differenza
ricade su un elemento del MUE contestato ritenuto secondario per le sue dimensioni
ridotte, i segni sono ritenuto visivamente molto simili.
Analoghe considerazioni valgono per il raffronto fonetico, per il quale la pronuncia dei
segni differisce unicamente per l’inversione delle lettere N’ e ‘C’, mentre coincide nel
suono delle rimanenti lettere “I-*-*-O-D-E-R-M”. Sebbene tali differenze si riscontrino
nella parte inziale dei segni, ritenuta maggiormente distintiva, la pronuncia delle sillabe
‘IN/CO’ e ‘IC/NO possiede una certa assonanza nella lingua italiana, la quale verrà
rinforzata dalla presenza della medesima sillaba finale ‘-DERM’, benché meno
distintiva. Pertanto, i segni sono molto simili sotto il profilo fonetico.
Sotto il profilo concettuale, anche se i segni nel loro insieme non hanno alcun
significato per il pubblico nel territorio di riferimento, in quanto le rispettive porzioni
inziali ‘INCO-’, nel segno anteriore, e ‘ICNO-’, nel MUE contestato, non sono
associabili ad alcun concetto, la parte finale “-DERM” inclusa in entrambi i segni, come
detto, verrà compresa con il significato di “pelle”. I segni presentano dunque una
marcata analogia concettuale, la quale, tuttavia, ricopre un ruolo secondario nella
presente analisi poiché basata su un elemento non distintivo rispetto ai prodotti
rilevanti.
Dato che i segni sono stati rilevati essere simili in almeno un aspetto del confronto,
l’esame del rischio di confusione procederà.
d) Carattere distintivo del marchio anteriore
Il carattere distintivo del marchio anteriore è uno dei fattori di cui tener conto nella
valutazione complessiva del rischio di confusione.

La richiedente non ha esplicitamente dichiarato che il suo marchio ha un carattere
particolarmente distintivo in virtù di un uso intensivo o della sua notorietà. Di
conseguenza, la valutazione del carattere distintivo del marchio anteriore si baserà sul
suo carattere distintivo intrinseco.
Nel caso in esame, nonostante la presenza della sequenza finale ‘-derm’, il marchio
anteriore risulta, nel suo complesso, privo di qualsiasi significato per il pubblico del
territorio di riferimento in relazione ai prodotti in questione. Pertanto, il carattere
distintivo del marchio anteriore deve essere considerato normale.
e) Valutazione complessiva, altri argomenti e conclusioni
Secondo una giurisprudenza costante, costituisce un rischio di confusione la possibilità
che il pubblico possa credere che i prodotti o i servizi in questione provengano dalla
stessa impresa o, eventualmente, da imprese economicamente collegate tra loro
(29/09/1998, C 39/97, Canon, EU:C:1998:442, § 29). Il rischio di confusione nella
mente del pubblico deve essere valutato globalmente, prendendo in considerazione
tutti i fattori pertinenti del caso di specie (29/09/1998, C 39/97, Canon, EU:C:1998:442,
§ 16). Inoltre, tale valutazione implica una certa interdipendenza tra i fattori che entrano
in considerazione, in particolare la somiglianza dei marchi e quella dei prodotti o dei
servizi designati. Pertanto, un tenue grado di somiglianza tra i prodotti o i servizi
designati può essere compensato da un elevato grado di somiglianza tra i marchi e
viceversa (29/09/1998, C 39/97, Canon, EU:C:1998:442, § 17).
Si è rilevato, in primo luogo, come i prodotti in conflitto siano identici e che essi siano
diretti al consumatore medio, il cui livello di attenzione è medio.
In secondo luogo, si è concluso che il segno anteriore deve ritenersi dotato, nel
complesso, di un carattere distintivo normale.
In terzo luogo, i segni in conflitto presentano elevate somiglianze a livello visivo e
fonetico, tenuto conto che l’elemento denominativo e dominante del marchio contestato
è costituito dalle medesime lettere del marchio anteriore e si differenzia da quest’ultimo
solamente per l’inversione della posizione delle lettere ‘N’ e ‘C’. Inoltre, gli elementi
figurativi del MUE contestato, che non trovano corrispondenza nel marchio italiano,
non sono sufficienti a ridurre la somiglianza complessiva tra i segni, posto che si tratta
di elementi secondari nella presente analisi. Per completezza, si rileva che entrambi i
segni verranno associati al concetto di “pelle” per la presenza dell’espressione ‘-derm’,
ma tale coincidenza semantica non assume un impatto rilevante poiché basata su un
elemento atto ad indicare al pubblico italiano la destinazione d’uso dei prodotti rilevanti.
In quarto luogo, si deve tener conto del fatto che il consumatore medio solo raramente
ha la possibilità di procedere a un confronto diretto dei vari marchi, ma deve fare
affidamento sull’immagine non perfetta che ne ha mantenuto nella memoria.
Posto quanto sopra, la Divisione di Annullamento ritiene che sussista un rischio di
confusione da parte del pubblico di riferimento per i prodotti che sono stati considerati
identici e che la domanda di nullità basata sulla registrazione anteriore italiana debba
considerarsi fondata.
Ne discende che il marchio contestato deve essere dichiarato nullo per i prodotti
contestati in classe 3.

Dal momento che il diritto anteriore italiano determina l’esito positivo della domanda e
dell’annullamento parziale del marchio contestato per tutti i prodotti contro cui è stata
rivolta la domanda, non è necessario esaminare gli altri diritti anteriori invocati dalla
richiedente (16/09/2004, T 342/02, Moser Grupo Media, S.L., EU:T:2004:268).
SPESE
Ai sensi dell’articolo 109, paragrafo 1, RMUE, la parte soccombente in una procedura
di annullamento sopporta l’onere delle tasse e delle spese sostenute dall’altra parte.
Poiché risulta soccombente, la titolare del marchio dell’Unione europea deve
sopportare l’onere delle tasse di annullamento nonché tutte le spese sostenute dal
richiedente nel corso di tale procedimento.
Secondo l’articolo 109, paragrafi 1 e 7, RMUE e l’articolo 18, paragrafo 1, lettera c),
punto ii), REMUE, le spese da rimborsare al richiedente sono le tasse di annullamento
e le spese di rappresentanza, che devono essere determinate sulla base degli importi
massimi ivi stabiliti.

Ai sensi dell'articolo 67 RMUE, ognuna delle parti di un procedimento conclusosi con
una decisione può ricorrere contro questa decisione a condizione che quest’ultima non
abbia accolto le sue richieste. Ai sensi dell'articolo 68 RMUE il ricorso deve essere
presentato per iscritto all'Ufficio entro due mesi a decorrere dal giorno della notifica
della decisione. È presentato nella lingua della procedura in cui è stata redatta la
decisione impugnata. Inoltre deve essere presentata una memoria scritta con i motivi
del ricorso entro quattro mesi da tale data. Il ricorso si considera presentato soltanto se
la tassa di ricorso di 720 EUR è stata pagata.
L’importo fissato nell’atto di determinazione delle spese potrà essere rivisto solo su
richiesta mediante decisione della divisione di annullamento. Ai sensi dell’articolo 109,
paragrafo 8, RMUE, tale richiesta dovrà essere presentata entro un mese dalla data di
notifica dell’atto di determinazione delle spese e si considererà presentata solo dietro
pagamento della tassa per il riesame della determinazione delle spese di 100 EUR
(Allegato I A paragrafo 33 RMUE).
