On 26/09/2017, the Opposition Division takes the following
DECISION:
1. Opposition No B 2 733 932 is partially upheld, namely for the following contested goods and services:
Class 5: Pharmaceuticals, medical and veterinary preparations; sanitary preparations for medical purposes; dietetic food and substances adapted for medical or veterinary use, food for babies; dietary supplements for humans and animals; plasters, materials for dressings; material for stopping teeth, dental wax; disinfectants; preparations for destroying vermin; fungicides, herbicides; pharmaceutical preparations for the treatment and prophylaxis of infectious diseases, cancer and immune system diseases and disorders, auto immune system diseases, and blood disorders.
Class 42: Scientific and technological services and research and design relating thereto; research and development in the pharmaceutical and biotechnology fields.
2. European Union trade mark application No 15 221 261 is rejected for all the above goods and services. It may proceed for the remaining services.
3. Each party bears its own costs.
REASONS:
The opponent filed an opposition against all the goods and services of European Union trade mark application No 15 221 261. The opposition is based on, inter alia, European Union trade mark registration No 10 207 249, for the word mark 'APTEO'. The opponent invoked Article 8(1)(b) EUTMR.
LIKELIHOOD OF CONFUSION – ARTICLE 8(1)(b) EUTMR
A likelihood of confusion exists if there is a risk that the public might believe that the goods or services in question, under the assumption that they bear the marks in question, come from the same undertaking or, as the case may be, from economically linked undertakings. Whether a likelihood of confusion exists depends on the appreciation in a global assessment of several factors, which are interdependent. These factors include the similarity of the signs, the similarity of the goods and services, the distinctiveness of the earlier mark, the distinctive and dominant elements of the conflicting signs and the relevant public.
The opposition is based on more than one earlier trade mark. The Opposition Division finds it appropriate to first examine the opposition in relation to the opponent’s EUTM No 10 207 249 for the word mark 'APTEO'.
- The goods and services
The goods and services on which the opposition is based are the following:
Class 5: Pharmaceutical preparations, medical products, vitamins, minerals, mineral food supplements, mineral water for: medical purposes, parapharmaceuticals, dietary supplements for medical purposes, dietetic foodstuffs adapted for medical purposes, dietetic substances adapted for medical use, herbal preparations, medicinal herbs, medicinal teas, biocides, biological preparations, antibacterial preparations, vaccines, serums, preparations derived from blood, biotechnological preparations, pharmaceutical preparations for skin care, anti-acne preparations, dental preparations and materials, pharmaceutical liquids, food for babies, plasters, plaster dressings, materials for dressings, sanitary preparations for medical purposes, disinfectants; veterinary preparations, chemical preparations for medical science, diagnostic preparations for medical purposes, disinfectants; dietary supplements for human consumption.

Class 44: Medical services; veterinary services; hygienic and beauty care for human beings or animals; pharmacy advice, nursing homes, medical clinics; pharmaceutical services in the field of prescription medicines.
The contested goods and services are the following:
Class 5: Pharmaceuticals, medical and veterinary preparations; sanitary preparations for medical purposes; dietetic food and substances adapted for medical or veterinary use, food for babies; dietary supplements for humans and animals; plasters, materials for dressings; material for stopping teeth, dental wax; disinfectants; preparations for destroying vermin; fungicides, herbicides; pharmaceutical preparations for the treatment and prophylaxis of infectious diseases, cancer and immune system diseases and disorders, auto immune system diseases, and blood disorders.
Class 42: Scientific and technological services and research and design relating thereto; industrial analysis and research services; design and development of computer hardware and software; research and development in the pharmaceutical and biotechnology fields.
The relevant factors relating to the comparison of the goods or services include, inter alia, the nature and purpose of the goods or services, the distribution channels, the sales outlets, the producers, the method of use and whether they are in competition with each other or complementary to each other.
Contested goods in Class 5
The contested pharmaceuticals, medical and veterinary preparations; sanitary preparations for medical purposes; dietetic food and substances adapted for medical use, food for babies; dietary supplements for humans; plasters, materials for dressings; disinfectants are identically contained in both lists of goods (including synonyms).
The contested dietetic food and substances adapted for veterinary use are included in the opponent's dietetic foodstuffs adapted for medical purposes, dietetic substances adapted for medical use. They are identical.
The contested dietary supplements for animals are included in the broad category of the opponent’s veterinary preparations. Therefore, they are identical.
The contested material for stopping teeth, dental wax are included in the broad category of the opponent’s dental preparations and materials. Therefore, they are identical.
A biocide is defined in the European legislation as a chemical substance or microorganism intended to destroy, deter, render harmless, or exert a controlling effect on any harmful organism by chemical or biological means. In view of this, the contested preparations for destroying vermin; fungicides, herbicides are included in the broad category of, or overlap with, the opponent’s biocides. Therefore, they are identical.
The contested pharmaceutical preparations for the treatment and prophylaxis of infectious diseases, cancer and immune system diseases and disorders, auto immune system diseases, and blood disorders are included in the broad category of the opponent’s pharmaceutical preparations. Therefore, they are identical.
Contested services in Class 42
The contested scientific services and research and design relating thereto and the opponent's medical services in Class 44 can coincide in provider, end user and distribution channels. Furthermore they are complementary. Therefore they are similar.
While the contested technological services and research and design relating thereto and the opponent's medical apparatus and instruments in Class 10 are of a different nature and have different purposes and methods of use, they can coincide in provider and target the same public such as hospitals. Therefore they are similar.
The contested research and development in the pharmaceutical and biotechnology fields and the pharmacy advice in Class 44 are of a different nature and have different purposes but the latter can be the corollary of the former. Indeed, the same provider can offer research and development activities in the pharmaceutical and biotechnology fields to third parties and offer pharmacy advice to the same public and through the same channels in relation to the outcome of these research and development services. Therefore, these services are similar.
On the other hand, apart from being different in nature, purpose and method of use, the contested industrial analysis and research services; design and development of computer hardware and software and the above listed opponents' goods and services in Classes 5, 10, 30 and 44, are not targeted at the same public, are not sold/provided by the same companies or through the same channels. Therefore, they are dissimilar.
- Relevant public — degree of attention
The average consumer of the category of products concerned is deemed to be reasonably well informed and reasonably observant and circumspect. It should also be borne in mind that the average consumer’s degree of attention is likely to vary according to the category of goods or services in question.
In the present case, the goods and services found to be identical or similar are directed at business customers with specific professional knowledge or expertise but some of the goods in Class 5 are also directed at the public at large.
In the present case, regarding the services in Class 42, these are considered rather specialised and sophisticated services and the degree of attention of the relevant public is deemed to be higher than average for such services.
Regarding the goods in Class 5, it is apparent from the case-law that, insofar as pharmaceutical preparations are concerned, the relevant public’s degree of attention is relatively high, whether or not issued on prescription (15/12/2010, T-331/09, Tolposan, EU:T:2010:520, § 26; 15/03/2012, T-288/08, Zydus, EU:T:2012:124, § 36 and cited case-law). In particular, medical professionals have a high degree of attentiveness when prescribing medicines. Non-professionals also have a higher degree of attention, regardless of whether the pharmaceuticals are sold without prescription, as these goods affect their state of health. The same degree of attention can be expected for the remaining goods in Class 5 as they also affect one's state of health.

The relevant territory is the European Union.
The global appreciation of the visual, aural or conceptual similarity of the marks in question must be based on the overall impression given by the marks, bearing in mind, in particular, their distinctive and dominant components (11/11/1997, C-251/95, Sabèl, EU:C:1997:528, § 23).
Both signs are word marks and neither has a meaning for the relevant public. Therefore they are distinctive.
Visually, the signs coincide in the letters 'APTE-(*)-O’ whereas they differ in the additional letter 'V' in the contested sign placed in penultimate position. Therefore, the signs are highly similar.
Aurally, irrespective of the different pronunciation rules in different parts of the relevant territories, the pronunciation of the signs coincides in the sound of the letters ‛APTE-*-O', present identically in both signs. The pronunciation differs in the sound of the letter ‛V’ of the contested sign, which has no counterpart in the earlier mark. Therefore, the signs are highly similar.
Conceptually, neither sign has a meaning for the public in the relevant territories. Since a conceptual comparison is not possible, the conceptual aspect does not influence the assessment of the similarity of the signs.
As the signs have been found similar in at least one aspect of the comparison, the examination of likelihood of confusion will proceed.
- Distinctiveness of the earlier mark
The distinctiveness of the earlier mark is one of the factors to be taken into account in the global assessment of likelihood of confusion.
The opponent claimed that the earlier trade mark enjoys enhanced distinctiveness but did not file any evidence in order to prove such a claim within the time limit set for the opponent to substantiate the earlier rights and submit further material (30/11/2016).
Consequently, the assessment of the distinctiveness of the earlier mark will rest on its distinctiveness per se. In the present case, the earlier trade mark as a whole has no meaning for any of the goods and services in question from the perspective of the public in the relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as normal.
- Global assessment, other arguments and conclusion
The appreciation of likelihood of confusion on the part of the public depends on numerous elements and, in particular, on the recognition of the earlier mark on the market, the association which can be made with the registered mark, the degree of similarity between the marks and between the goods or services identified (recital 8 of the EUTMR). It must be appreciated globally, taking into account all factors relevant to the circumstances of the case (22/06/1999, C342/97, Lloyd Schuhfabrik, EU:C:1999:323, § 18; 11/11/1997, C251/95, Sabèl, EU:C:1997:528, § 22).
In addition, the global assessment of the risk of confusion entails certain interdependence between the factors taken into account and, in particular, between the similarity of the trademarks and the similarity of the goods or services covered. Accordingly, a low degree of similarity between those goods or services may be offset by a high degree of similarity between the marks, and vice versa (23/10/2002, T-6/01, Matratzen, EU:T:2002:261, § 25).
The goods and services, found to be identical or similar, are directed at the public at large and/or at business customers whose degree of attention is higher than average. The degree of distinctiveness of the earlier sign is one of the factors to be taken into account in the overall assessment (11/11/1997, C-251/95, Sabèl, EU:C:1997:528, § 23). In the present case, the distinctiveness of the earlier marks must be seen as normal. The signs are visually and aurally similar to a high degree. They only differ in the additional letter/sound 'V' and there is no concept that helps distinguishing them further.
Account is taken of the fact that average consumers rarely have the chance to make a direct comparison between different marks, but must trust in their imperfect recollection of them (22/06/1999, C-342/97, Lloyd Schuhfabrik, EU:C:1999:323, § 26). Even consumers who pay a high degree of attention need to rely on their imperfect recollection of trade marks (21/11/2013, T-443/12, ancotel, EU:T:2013:605, § 54).
Considering all the above, the Opposition Division finds that there is a likelihood of confusion on the part of the public and therefore the opposition is partly wellfounded on the basis of the opponent’s European Union and Polish trade mark registrations.
It follows from the above that the contested trade mark must be rejected for the goods and services found to be identical or similar to those of the earlier trade mark.
The rest of the contested services are dissimilar. As similarity of goods and services is a necessary condition for the application of Article 8(1) EUTMR, the opposition based on this article and directed at these services cannot be successful.
The opponent has also based its opposition on the following earlier trade marks among which are other word marks 'APTEO' for which the opponent also claimed enhanced distinctiveness but did not file any evidence in order to prove such claim within the time limit set to substantiate the earlier rights and submit further material (30/11/2016). Therefore, the distinctiveness of these earlier word marks must be seen as normal. Likewise, and for the sake of completeness, the distinctiveness of the remaining earlier marks must also be seen as normal despite the presence of elements that are possibly weak or non-distinctive but will not be analysed for reasons of economy of procedure.

Since these marks cover essentially the same scope of goods and services in Classes 5, 10, 30 and 44, the outcome cannot be different with respect to services for which the opposition has already been rejected, namely industrial analysis and research services; design and development of computer hardware and software in Class 42. In any event, in relation to earlier goods and services in the same classes that should not have been contemplated in the above comparison and in relation to other earlier goods and services in other classes covered by these marks, namely those in Classes 3, 35 and 41, the same reasons for concluding to their dissimilarity with the remaining contested goods can be stated, namely that apart from being different in nature, purpose and method of use, the contested industrial analysis and research services; design and development of computer hardware and software in Class 42 and the earlier goods and services covered by the above marks are not targeted at the same public, are not sold by the same companies or through the same channels. Therefore, they are dissimilar.
Therefore, no likelihood of confusion exists with respect to the remaining services.
COSTS
According to Article 85(1) EUTMR, the losing party in opposition proceedings must bear the fees and costs incurred by the other party. According to Article 85(2) EUTMR, where each party succeeds on some heads and fails on others, or if reasons of equity so dictate, the Opposition Division will decide a different apportionment of costs.
Since the opposition is successful only for part of the contested goods and services, both parties have succeeded on some heads and failed on others. Consequently, each party has to bear its own costs.

According to Article 59 EUTMR, any party adversely affected by this decision has a right to appeal against this decision. According to Article 60 EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. It must be filed in the language of the proceedings in which the decision subject to appeal was taken. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 720 has been paid.
